Terms of Service

These Terms of Service (“Terms”) are an agreement between you and GEXMAP LLC, a Wyoming limited liability company (“Gexmap,” “we,” “us”). They govern your use of gexmap.com, the Gexmap platform, its tools, alerts, research and backtests, and our community channels (the “Services”). By creating an account, subscribing or using the Services, you agree to these Terms and to our Privacy Policy.

1. Not financial advice

• GEXMAP LLC is not a registered investment adviser, broker-dealer, commodity trading advisor or futures commission merchant.
• Trading options and futures involves substantial risk of loss and is not suitable for every investor. You can lose more than your initial investment. You are solely responsible for your own trading decisions and results.
• Hypothetical and backtested results have inherent limitations. They are prepared with the benefit of hindsight, do not reflect actual trading, and do not account for all real-world factors such as liquidity, slippage and fees. Past or simulated performance does not guarantee future results.

2. Eligibility and accounts

• You must be at least 18 years old and able to form a binding contract to use the Services.
• Your subscription is for one individual. Do not share your login or let others use your account; we may limit an account to one active session at a time.
• Keep your login secure and tell us right away about any unauthorized use. You are responsible for activity under your account.

3. Subscriptions and billing

• Plans and prices are listed on our Pricing page. Prices are in US dollars; applicable taxes are added at checkout.
• Automatic renewal: paid plans renew automatically at the end of each billing period and your payment method is charged, until you cancel. By subscribing, you authorize these recurring charges.
• Cancellation: you can cancel anytime; cancellation takes effect at the end of the current paid period. Refunds are governed by our Refund & Cancellation Policy.
• Price changes: we will give at least 30 days’ notice by email before a price change applies to your subscription.
• Failed payments: if a payment fails or is reversed, we may suspend access to the platform and community until the balance is paid.
• Payments are processed by Stripe, subject to its terms.

4. Market data and third-party sources

• The Services use data from exchanges and third-party providers. Data may be delayed, incomplete, revised or inaccurate, and the Services may be interrupted. We do not guarantee the accuracy, completeness or timeliness of any data, calculation or output.
• Data and content are licensed to you for your own personal, non-commercial use within the Services. You may not redistribute, resell, publish, scrape or export market data or our derived data, except for occasional screenshots shared for discussion with attribution to Gexmap.
• Some providers impose their own terms on how their data may be used; you agree to follow any such terms we make available to you.

5. Acceptable use

You agree not to:

• copy, resell, sublicense, frame or commercially exploit the Services or their content;
• scrape, crawl or use automated means to extract data, or interfere with or overload the Services;
• reverse engineer, decompile or try to access source code or non-public systems, except as the law allows;
• bypass access controls, session limits or security measures, or share account access;
• use the Services for anything unlawful, including market manipulation, or to harass others.

6. Community

Subscribers may get access to our private Discord server. Be respectful, keep discussion on topic, and do not share paid content outside the community. Community posts are the views of their authors, not Gexmap, and are not financial advice. We may remove content or members who break these Terms. Community access ends when your subscription ends.

7. Intellectual property

The Services, including the software, designs, visualizations, signals, research, text and trademarks (including the Gexmap name and logo), belong to GEXMAP LLC and its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your own personal, non-commercial purposes while your account is in good standing. If you send us feedback or ideas, we may use them without obligation to you.

8. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GEXMAP LLC AND ITS MEMBERS, EMPLOYEES AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY TRADING LOSSES, LOST PROFITS OR LOST DATA, ARISING FROM OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

10. Indemnification

You agree to indemnify and hold harmless GEXMAP LLC and its members from claims, losses and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your trading, or your violation of these Terms or of law.

11. Suspension and termination

You may stop using the Services and cancel at any time. We may suspend or end your access if you violate these Terms, if a payment fails, or if required by law or our data providers. Sections that by their nature should survive termination (including sections 1, 4, 7, 8, 9, 10 and 12) will survive.

12. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Wyoming, and you consent to their jurisdiction. Before filing a claim, please contact us so we can try to resolve it informally.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will post the new Terms here with a new date and notify subscribers by email. Continuing to use the Services after the changes take effect means you accept them.
